Click here to download/view In it, the Government of New South Wales has given itself the power to remove people forcibly from their own land if it deems "... priority areas or regions for projects to mitigate the impact of disasters..." (Part 4, 31 (2) C.) Environmental Planning Asessment Act 1979." So how does this happen? All the Government has to do is declare an area a reconstruction or disaster prevention area and declare certain projects as part of it. Declare it, as in publish in the Gazette. " However, the Minister may make a declaration under subsection (1) only if— (a) the Minister is satisfied the project will be carried out in a part of the State that has been directly or indirectly affected by a disaster..."
