How the NSW Government CAN ALREADY TAKE YOUR LAND, Simply by Declaring it a 'Disaster Prevention Area'
This was announced YESTERDAY. In 2022 the NSW Government passed a law that no one has heard of. The Reconstruction Authority Act 2022. It is a scary document. Click here to download/view
In it, the Government of New South Wales has given itself the power to remove people forcibly from their own land if it deems "...priority areas or regions for projects to mitigate the impact of disasters..." (Part 4, 31 (2) C.) Environmental Planning Asessment Act 1979."
So how does this happen?
All the Government has to do is declare an area a reconstruction or disaster prevention area and declare certain projects as part of it. Declare it, as in publish in the Gazette. "However, the Minister may make a declaration under subsection (1) only if— (a) the Minister is satisfied the project will be carried out in a part of the State that has been directly or indirectly affected by a disaster..." (Part 5 39.2 a)
You can see where this is going.
Part 6.43 C states where: "A minister of the state declares a part of the state to be a disaster prevention area..." Deemed to be affected either directly or indirectly.
For the "Betterment of the community..." Who decides that? Not the community, that's for sure.
Now, here is where it gets really scary -
Read below: "...the power to acquire land..." and "...demolish... any building within or adjoining in the vicinity of the land..." Read more below.
How does it apply to those of us WHO DO NOT WANT WIND TURBINES ON OUR LAND?
With the rabid push for 'renewables' and 'green energy' solutions to the supposed climate or energy crisis, the Government can enact laws such as this to push through projects which it deems mitigate disasters. It's that simple. And if that happens, there is NOTHING you can do about it. Not even your local council can help you, even if it wanted to. If it becomes state law you will have no recourse, as a landowner. The government of the day can force you off your land, take it over, demolish your house and outbuildings, sell the land to private developers, subdivide it, do what they want. Look at 47b on page 30: "...grant easements or rights-of-way over the land or part of the land."
